1. PROMOTER AND PARTICIPANTS
1.1. The Promoters are
Canon Europa N.V and registered at Bovenkerkerweg 59, 1185 XB, Amstelveen,
the Netherlands and
Canon Middle East FZ-LLC, a company duly incorporated in the Dubai Technology
and Media Free Zone, Dubai, United Arab Emirates, whose registered address is located at P.O. Box 500007, Dubai,
United Arab Emirates wherein and hereto referred to as ("
CANON"). Any company, any subsidiary,
partnership or other entity which from time to time is controlled by or is under common control of Canon hereinafter
will be referred to as “Canon Affiliate” and, Canon and Canon Affiliate together will be referred to as "Canon
Group".
1.2. All entrants (“Participants”) must be amateur photographers who are United Arab Emirates, Saudi Arabia, Qatar,
Bahrain, Jordan, Kuwait, Lebanon, Oman, Iraq, Yemen, Algeria, South Africa, Estonia, Latvia, Lithuania, Benin,
Burkina Faso, Burundi, Cameroon, Cape Verde, Central African Republic, Chad, Comoros, Democratic Republic of Congo,
Djibouti, Egypt, Equatorial Guinea, Eritrea, Ethiopia, Gabon, Ghana, Guinea, Guinea-Bissau, Ivory Coast, Kenya,
Liberia, Libya, Mali, Mauritania, Mayotte, Morocco, Niger, Nigeria, Republic of Congo, Rwanda, Saint Helena, Sao
Tomé e Príncipe, Senegal, Sierra Leone, Somalia, Tanzania, The Gambia, Togo, Tunisia, Uganda, Switzerland, Belgium,
United Kingdom, Republic of Ireland, Netherlands, Sweden, Norway, Austria, Germany, Denmark, Italy, Finland, Spain,
Portugal, France, Bulgaria, Croatia, Greece, Romania, Slovenia, Serbia, Macedonia, Ukraine, Bosnia, Uzbekistan,
Azerbaijan, Western Sahara residents aged 18 or over.
1.3. Employees of Canon, its subsidiary companies, their families, agents, and other parties directly involved with
this promotion and the sponsorship are not eligible to enter.
1.4. By entering this competition, all participants are deemed to have agreed to be bound by these terms and
conditions unless notified otherwise in writing.
2. THE COMPETITION
2.1.
Promotion Period: Enter between 00:01 GMT on 28th October 2021 and 23:59 on 28th January 2022
inclusive.
2.2. Moment that matter is a sustainability competition which is focuses on four (4) important themes:
(i) Moments that heal us:
Human sustainability methods improve and preserve the quality of our lives. Focus on one of the sub-topics below for
your submission.
• Healthy environment, healthy people: The people and planet are connected. Find the ways the health of humans and
planet are intertwined and can lead to preventative care.
• Humanity and nature thrive together: Different countries and cultures learn to adapt and embrace their natural
environment. How do they enhance sustenance and balance needs for now and the future?
(ii) Moments that develop us:
Creating abundance and economic growth matters as we aim to be more efficient and profitable. Focus on one of the
sub-topics below for your submission.
• Environmental economy: Reveal how companies are serving the planet and bridging the gap between economics and the
environment.
• Circular economy: What are businesses and people doing to use fewer resources and move towards a zero-waste
future?
(iii) Moments that make us:
Meeting our present needs without compromising the future ensures environmental sustainability. Focus on one of the
sub-topics below for your submission.
• The beauty of biodiversity: Conservation, healthy habits, and corporate action preserve nature. What actions are
helping renew depleted resources and combat climate change?
• Nature regeneration and restoration: How does nature solve issues posed by humanity? Share bold actions and
solutions that reduce risk and negative impacts.
(iv) Moments that save us:
Show how nature contributes to innovating, designing, and developing for social change. Focus on one of the
sub-topics below for your submission.
• Genius of nature: We learn to emulate nature in many ways. What are ways we learn from nature to meet our basic
needs?
• Natural connections: Time and harmony with nature can make us kinder, happier, and creative. So how do we
integrate nature into our lives to ensure prosperity and fulfilment?
2.3. During the Promotion Period, each Participant may select only 1 (one) out of the four (4) themes described
above and submit up to 5 photographs along with a caption. Please note, the same photograph cannot be entered more
than once.
2.4. Visit the
submission
page and complete the online form to provide your details. Then upload your submission meeting the criteria
listed below in Clause 3 to be entered into the competition. Participants will receive a confirmation email once a
submission is completed.
2.5. Multiple entries are not permitted. For clarification purposes, one entry means a maximum of five (5)
photographs plus a caption relating to only one (1) of the themes described in Clause 2.2.
2.6. No purchase is necessary. It is free to enter this competition and photographs do not have to be taken on a
Canon device.
2.7. Internet access and a valid email address are required to enter.
2.8. Incomplete, invalid, or inappropriate entries, or entries received after the closing date on the 28th January
2022 at 23:59 GMT will not be eligible for publication or any prize.
2.9. By submitting an entry, each Participant hereby grants to Canon Group a non-revocable, worldwide, royalty-free
and free of charge, sublicensable licence to publish, republish, display and use their photograph without
restriction for all purposes connected with this competition, including but not limited to display on Canon Group
websites, Canon Group social media accounts and/or channels, any other websites of Canon Group or its
agents/contractors, and in marketing materials (including at exhibitions) relating to this competition for up to one
year after the competition ends. Each Participant also grants Canon Group and its agents/contractors the right to
moderate, modify or remove any photograph if it is deemed unsuitable, in whole or in part, for display on the
competition website or in any materials relating to the competition. Participants of the competition also hereby
agree to being identified and/or attributed as the photographer or creator of the photograph subject to their entry.
3. IMAGE CRITERIA
3.1. The photographs submitted must reflect the following criteria:
a) Reflect the challenge: (i) Moments that heal us, (ii) Moments that develop us, (iii) Moments
that Make us and, (iv) Moments that save us
b) Creativity – Is your entry fresh and original?
c) Impact – What emotions or reactions are evoked from the submission. Is the submission amusing,
emotional and thought provoking?
d) Technical prowess -Has the image been captured in a way that demonstrates an understanding of the
abilities of the camera and the subject 3.2 Guidelines that needs to be followed
3.2. Image size should be 150DPI, 2000 px along the longest side. Participants must not upload images which have
been previously published or won an award or prize via a promotion run by the Promoters or any other entity.
3.3. The photographs submitted must not be heavily edited or manipulated, examples include: no adding or removing
objects from the image, no compositing images, and no watermarks. Please note, this list of examples is not an
exhaustive list.
4. COMPETITION REQUIREMENTS
4.1. The photograph(s) must be original and taken by the Participant.
4.2. The photograph(s) submitted by the Participant must not contain:
i) recognisable persons, unless the Participant can demonstrate that such persons have granted all the necessary
permissions in writing for the photograph to be submitted, used and published by Canon Group under Clause 2.9 of
these Terms and Conditions (please note, it is the responsibility of the Participant to ensure that the relevant
permission has been sought and model release forms have been satisfactorily completed); or
ii) works of art; or
iii) logos or brand names; or
iv) scenes which are offensive, obscene, sexual, derogatory, defamatory, violent, abusive, harassing, threatening,
objectionable with respect to race, related to religion, origin or gender, or which could reflect negatively upon
the name, reputation or goodwill of Canon Group or any brand partner, or which are otherwise unsuitable for
publication; or
v) anything that may infringe the rights of any third party, including intellectual property, moral or privacy
rights, or refer to any third-party brand or reference any third-party names, logos and/or trademarks; or
vi) any watermark, copyright notice or any other information which may identify the Participant (note, a copyright
notice embedded in the metadata of the photograph is permissible). For the judging process to remain as fair as
possible, the judging panel is not permitted to see the names of the Participants when judging. Any photograph
entered that contains a Participant’s name, any watermark, copyright notice or any other information which may
identify the Participant, will be disqualified, and will not be presented to the judging panel.
4.3. Participant agrees to be contacted by Canon for the purposes of administrating the competition or in the event
that Canon Group wishes to discuss any other use of the photographs submitted to the competition.
5. WARRANTIES
5.1. By submitting its entry, the Participant warrants that:
i) The Participant is the sole author of the photograph.
ii) The Participant is the owner of the proprietary rights in the photograph.
iii) The photograph and any element appearing in the photograph do not infringe the rights (including intellectual
property, moral or privacy rights) of any third party.
iv) In the case where a person or person’s image appears in the photograph, the Participants has obtained written
permission from those person(s) for Canon Group to use their image(s) as described in these terms and conditions and
the appropriate model release forms have been satisfactorily completed; and
v) In the case where the photograph has been taken in another country from where the participant is based
Participant has complied with the law applicable to such country, including but not limited to any intellectual
property, moral, privacy and any proprietary legal requirements.
5.2.Canon warrants to act within the scope of the rights granted under these Terms and Conditions.
6. THE PRIZE
6.1. The winners of this competition will be awarded the following Prizes:
6.1.1. The Grand Prize: One (1) winner will be selected by a panel of judges and awarded a cash prize of eight
thousand American dollars (8000$) (subject to tax if applicable).
6.1.2. The Category Prize: Four (4) winners will be selected by the judges for each of the themes: i)Moments that
saves us, ii)Moments that heals us, iii)Moments that makes us, and iv)Moments that develop us. Each winner will
receive a gold coin weighing eight (8) grams.
6.1.3. The Peoples’ Choice Awards: The shortlisted photographs will be displayed by Canon in a physical and virtual
gallery and the public will vote for their favourite photographs. The Participant with the most votes will be the
winner and awarded a Canon EOS R5 camera and a Canon RF 24-70mm F2.8L IS USM lens.
6.2. Canon will notify the winner via the email address provided on participation of the competition within 5
working days of the winner selection and will be required to respond to confirm eligibility and acceptance of the
Prizes, within 14 calendar days of initial contact. If the winner does not respond to the initial contact within 14
calendar days Canon reserves the right to disqualify the winner. If the winner is disqualified Canon reserves the
right to award the prize to a reserve selected in the same manner. Reserve winners may have less time to respond.
6.3. Canon reserves the right to publish on Canon Group websites and social media platforms the name, town, and
country of the winner or to publicise any prize giving presentation after the date of the competition. If the winner
does not wish such details to be published, they must advise Canon at time of being notified that they have won.
6.4. The Prizes are non-transferable and in the event that the prize offered is unavailable due to circumstances
beyond our control, or if Canon has any difficulties awarding the Prizes due to local regulations and legislation in
the country of residence of the winners, or if the winner doesn’t provide the bank account details, Canon reserves
the right to offer an alternative prize of equal or greater value.
6.5. The Prize listed in Clause 6.1.1. will be transferred to the winner via bank transfer within ninety (90)
calendar days from the date the winner provides their bank details.
6.5.1 If any tax is payable as a result of the Prize listed in Clause 6.1.1. being awarded or received, it will be
the responsibility of the winner. The winner should seek independent financial advice prior to accepting the Prize
if this is a concern.
6.5.2 Subject to the above 6.5.1, depending on the local laws of the winner, it may be a legal requirement for Canon
to incur the tax responsibility which means the winner may receive a reduced amount.
6.6. If any tariff or similar charges are payable as a result of the Prize listed in Clause 6.1.2. being awarded or
received, it will be the responsibility of Canon. The winner should seek independent financial advice prior to
accepting the Prize if this is a concern.
6.7. The Prizes listed in Clause 6.1.2. and 6.1.3 will be posted to the winner within 30 calendar days after the
winner is announced. In the unlikely event that a Prize doesn’t arrive within 90 calendar days after the winner is
announced, the winner will have a further 28 calendar days to inform Canon by sending an email to
bmc.emea@canon-europe.com. If the winner does not inform Canon within this time frame, Canon will reserve the right
to not reissue the prize or limit its value at their sole discretion.
6.8. Any rejected or unclaimed prize may be awarded to other Participants at the absolute and sole discretion of
Canon.
6.9. In the event that the competition is not capable of running as planned for reasons including but not limited to
tampering, unauthorised intervention, fraud, dishonesty, technical failures, or any other causes beyond the control
of Canon which corrupt or affect the administration, security, fairness, integrity or proper conduct of this
competition, Canon reserves the right to disqualify any individual who tampers with the entry process or does not
comply with these Terms & Conditions and to cancel, modify or suspend the competition or invalidate any affected
entries.
6.10. No responsibility can be taken for entries which are lost, delayed, corrupted, damaged, misdirected, or
incomplete or which cannot be delivered for any technical, delivery or other reason. Proof of sending will not be
accepted as proof of receipt. Canon Group does not guarantee continuous or secure access to the entry page.
7. WINNER SELECTION
7.1. All valid entries received during the Promotion Period (subject to moderation) will be independently judged by
the following panel: (i) Fiona Shields (ii) Brent Stirton (iii) Muhammed Muheisen (iv) Kathy Moran (v) Aïda Muluneh.
7.2. Subject to Clause 7.2. the judges will select the five (5) winners for the Prizes listed in Clause 6.1.1 and
6.1.2 according to the criteria listed in Clause 3 and announced 17th March 2021.
7.3. Once the judges have selected the 5 winners, the judges will shortlist the images of thirty (30) Participants
to be displayed in a virtual and physical gallery.
7.4. Subject to Clause 7.3. the public will vote for their favourite image online and the Participant receiving the
most votes will be announced as the winner of the Prize listed in 6.1.3.
8. PERSONAL DATA
8.1. Canon Europa N.V., 59 Bovenkerkerweg, 1185 XB, The Netherlands and Canon Middle East FZ-LLC, a company duly
incorporated in the Dubai Technology and Media Free Zone, Dubai, United Arab Emirates, whose registered address is
located at P.O. Box 500007, Dubai, United Arab Emirates are the Data Controllers in respect of any personal data
supplied by Participants. The personal data provided is held securely and may be transferred on a secure server
outside the country of the data subject’ domiciles. The personal data collected from Participants is subject to the
Canon Consumer Privacy Policy.
8.2. Any and all personal data supplied for the running of this competition will be used solely for the purpose of
this competition and, if applicable, for marketing purposes by the Canon Group and/or by any agent appointed by it
to assist with running the competition on behalf of the Promoters and will not be disclosed to a third party for any
other purpose unless your positive consent has been obtained.
9. DISCLAIMER
9.1. Canon reserves the right to refuse to honour any entry or to recover the full value of any prize if it
considers there has been an abuse or breach of the terms and conditions of this competition.
9.2. Canon, Canon Group companies, together with any associated agencies and companies shall not be liable for any
loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage or
injury of any nature howsoever caused, sustained by any participant under this promotion. Nothing in these Terms and
Conditions will exclude or restrict Canon Group’s liability for personal injury or death caused by the proven
negligence of its employees or contractors.
9.3. In the event of a dispute over interpretation or implementation of the rules on any matter related to the
competition, the decision of the Directors of Canon is final, and no correspondence will be entered into.
9.4. If any part of these Terms and Conditions is found by a court of competent jurisdiction or other competent
authority to be invalid, unlawful or unenforceable, then such part shall be severed from the remainder of these
conditions, which shall continue to be valid to the fullest extent permitted by law.
9.5. Entries must be made directly by the individual entering the competition. Bulk entries from trade, consumer
groups or third parties will not be accepted. Incomplete or illegible entries and entries submitted by macros or
other automated means together with entries which do not satisfy the requirements of these Terms & Conditions in
full will be disqualified and will be not be counted. If it becomes apparent that a Participant is using a
computer(s) to circumvent this condition by, for example, the use of ‘script’, ‘brute force’, masking their identity
by manipulating IP addresses, using identities other than their own or any other automated means in order to
increase that Participant’s entries into the competition in a way that is not consistent with the rules of the
competition, that Participant ’s entries will be disqualified and any prize awarded will be void. Participant are
not permitted to enter using anonymous email services such as, but not limited to, GuerillaMail, Dispostable or
Mailinator.
9.6. In the event of a discrepancy between these Terms & Conditions and the details in any promotional material,
the details in the Terms & Conditions will prevail.

11. JURISDICTION
11.1 As you are a participating consumer, laws of your country of residence will apply to this Promotion, and You
may be entitled to bring court proceedings in your own language and in your local courts. A local consumer advice
organisation will be able to advise you on your rights. These Terms and Conditions do not restrict any statutory
rights that may be applicable.
